What is a Grant De Bonis Non?

A Grant De Bonis Non (formally known as a Grant De Bonis Non Administratis) is a type of Grant of Representation ‘concerning goods not administered’. A Grant De Bonis Non is required when a Grant of Representation has been issued, but the last surviving Personal Representative (Executor or Administrator) named on this Grant dies or loses mental capacity prior to the completion of the administration of the estate. An application for a Grant De Bonis Non is made to the Probate Registry. Once issued, it will allow for the administration of an estate to be finalized by a new Personal Representative.

It is important to note that a Grant De Bonis Non is only required in certain circumstances, such as when the last surviving executor of the estate dies without making a valid Will (dies intestate). If the last surviving executor did leave a valid Will prior to their death, then the executor(s) appointed on this Will can finalise the administration of the original estate without a Grant De Bonis Non being obtained. This is known as the ‘chain of representation’.
