Topic Tuesdays- Change of Name

People wish to change their name for a variety of reasons, including legal requirements, traditions, and personal choice. Once you have made the decision to change your name, a Statutory Declaration is one way to formally do it.

A Statutory Declaration is a legal document used to affect the procedure of name change through solicitors. On your behalf, we will draft the Statutory Declaration, which you must thereafter "swear" and sign in front of an Independent Solicitor. An Independent Solicitor will be paid a small commissioner fee in exchange for witnessing the document

If you wish to change the name of a child, it can only be possible by someone who has parental responsibility for the child. All parents who share parental responsibility for the child must consent to the name change.

In the event that they object to the name change, we would have to submit a Specific Issue application to the Court. The Court will consider a number of factors, but ultimately make a decision based on what they believe is best for your child.
